1. Scope of application
These terms and conditions of sale govern all contracts concluded between Bandini Pharma S.r.l. and customers through the official Bandini Pharma website.
Any general terms and conditions of the customer shall not apply unless expressly accepted in writing by Bandini Pharma S.r.l.
Bandini Pharma S.r.l. reserves the right to modify or update these terms and conditions of sale at any time. The terms applicable to each order shall be those published on the website at the time the order is submitted by the customer.
2. General information
- All prices indicated on the website include VAT unless otherwise specified.
- Sales through the website are governed by the regulations applicable to distance selling and electronic commerce.
- Food supplements are not tax-deductible, even if prescribed by a doctor.
- Bandini Pharma S.r.l. reserves the right to modify product prices at any time. In the event of an obvious error in the price indicated on the website, the order may be cancelled with a full refund of any amount already paid.
3. Purchase procedure
Purchases may be made exclusively through the official Bandini Pharma website.
The information and product descriptions available on the website are provided for informational purposes only and do not constitute a binding contractual offer.
After completing the purchase process, the customer will receive an email containing the order summary.
4. Conclusion of the contract
The sales contract shall be considered concluded when Bandini Pharma S.r.l. sends the order confirmation to the customer by email or when the ordered goods are dispatched.
5. Correction of errors before submitting the order
Before submitting the final order, the customer has the possibility to verify the entered data and correct any errors through the standard editing functions available during the purchase process.
6. Contract language
The language available for the conclusion of the contract is the one selected by the customer while browsing the website.
7. Payment methods
The available payment methods are indicated to the customer during the purchase procedure and may vary depending on the country of delivery and the options available at the time of the order.

Credit card payments are processed through the payment service provider Stripe Payments Europe Ltd., based in Ireland. -
PayPal
Payments made via PayPal are handled by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A. -
Other payment methods
Depending on the country of delivery and the options available at the time of the order, additional payment methods may be available, including advance bank transfer or cash on delivery.
Bandini Pharma S.r.l. does not store or have access to the full payment card details used by the customer.
8. Shipping
Shipping costs are automatically calculated in the shopping cart based on the delivery address provided by the customer.
Shipments are carried out through the GLS courier service or other carriers selected by Bandini Pharma S.r.l., depending on the destination country and logistical requirements.
The delivery times indicated on the website are to be considered indicative and not binding.
International shipments are carried out in compliance with the regulations applicable in the respective destination countries.
For shipments to countries outside the EU, any customs duties, local taxes or other import charges shall be borne by the recipient.
9. Failed delivery due to the customer
If delivery cannot be completed due to reasons attributable to the customer, such as an incorrect or incomplete address, absence of the recipient, or failure to collect the parcel, Bandini Pharma S.r.l. reserves the right to charge any costs incurred for storage, return of the goods or a new shipment.
10. Verification of goods upon delivery
The customer is required to verify, upon delivery, the integrity of the package and the correspondence between the number of parcels received and what is indicated by the courier.
Any visible anomalies (e.g. damaged, opened, tampered package or incorrect number of parcels) must be reported immediately to the courier, accepting the delivery with specific reservation, and notified within no more than 48 hours via the contact page on the website.
In the absence of immediate notification to the courier at the time of delivery or notification within the above-mentioned timeframe, we reserve the right not to accept any claims relating to damage or missing items, without prejudice to mandatory rights under applicable law.
11. Product unavailability
If one or more ordered products are unavailable, even temporarily, the customer will be promptly informed and any amount already paid will be fully refunded.
12. Retention of title
The products remain the property of Bandini Pharma S.r.l. until full payment of the sale price has been received.
13. Legal warranty
All products sold through the website are covered by the legal guarantee of conformity provided for in Articles 128–135-septies of the Italian Consumer Code.
The legal warranty applies to consumers and lasts for two years from the delivery of the goods.
In the event of a lack of conformity, the customer may contact Bandini Pharma S.r.l. through the contact page of the website.
14. Right of withdrawal
Bandini Pharma S.r.l. grants the customer the right to withdraw from the contract within 30 days from the day on which the customer acquires possession of the goods.
According to Article 59 of the Italian Consumer Code, the right of withdrawal does not apply to sealed goods that are not suitable for return due to health protection or hygiene reasons if they have been opened after delivery.
Therefore, food supplements may only be returned if they are intact, unopened and with the original seal unbroken.
15. Effects of withdrawal
In the event of withdrawal, all payments received from the customer will be refunded, including standard delivery costs.
The refund will be made using the same means of payment used for the initial transaction, where possible.
If the payment was made using methods that do not allow automatic reimbursement to the same payment method, the refund may be made by bank transfer after the necessary bank details have been provided.
The refund may be withheld until the goods have been received or until the customer provides proof that the goods have been returned.
The direct cost of returning the goods shall be borne by the customer.
16. Limitation of liability
Bandini Pharma S.r.l. shall not be liable for disruptions resulting from force majeure, technical issues, interruptions of the internet network or service failures attributable to courier services.
Liability shall in any case be excluded within the limits permitted by law and except in cases of wilful misconduct or gross negligence.
17. Technical errors and product availability
Bandini Pharma S.r.l. makes every effort to ensure the accuracy of the information published on the website. However, due to technical errors, system malfunctions, data synchronization issues or other IT anomalies, inaccuracies relating to prices, product availability or other information may occur.
In the event of obvious or manifestly incorrect errors, such as prices equal to zero, unrealistically low prices or other inconsistencies resulting from technical or system errors, Bandini Pharma S.r.l. reserves the right to cancel the order even after it has been received.
In such cases the customer will be informed promptly and any amount already paid will be fully refunded using the same payment method used for the purchase or another method agreed with the customer.
The automatic confirmation of receipt of the order does not constitute final acceptance of the order, which remains subject to verification of the correctness of the information and the availability of the products.
The order submitted by the customer through the website constitutes a contractual offer. Bandini Pharma S.r.l. reserves the right to accept or reject such offer following internal checks regarding the correctness of the information, the availability of the products and the absence of technical errors.

19. Applicable law
Contracts concluded through the website are governed by Italian law.
If the customer is a consumer residing in a Member State of the European Union, any more favourable provisions provided by the law of the consumer’s country of residence shall remain applicable.
20. Jurisdiction
For any dispute relating to the interpretation or performance of this contract, if the customer is a consumer, jurisdiction shall lie with the court of the place of residence or domicile of the consumer.
If the customer acts in the course of their business or professional activity, the exclusive jurisdiction shall be the court of Rimini.
21. Alternative dispute resolution
A consumer residing in the European Union has the possibility to use the European Online Dispute Resolution (ODR) platform provided by the European Commission.

Bandini Pharma S.r.l. is neither obliged nor willing to participate in dispute resolution procedures before consumer mediation bodies.
